Physical therapists have become more autonomous with the passage of direct access laws that allow consumers to see a physical therapist without a referral from a physician.

Malpractice or medical error has therefore become more important to patient safety and the public perception of the profession. While the malpractice incident rate remains extremely low compared to other medical professions, there are still situations that result in injury or harm to a patient because of poor clinical judgement, negligent care or accidents. Incidence of malpractice by physical therapists is low (estimated at 2.5 events/10,000 working therapists/year), and the average malpractice payment is small (<$15,000). “Treatment-related” events and events related to “improper technique” were the most common reasons for a malpractice report.

Dr. Bertone is the current Chairman of the New Jersey Board of Physical Therapy Examiners (NJBPTE) and has been a sitting board member since 2012 after being appointed by then Governor Chris Christie. He has been responsible for helping develop landmark physical therapy rules and regulations including dry needling, PT ordering of radiology and neuro-diagnostic testing and streamlined continuing education course approvals.

Past expert witness clients have included prestigious malpractice law firms as well as insurance carriers helping them with numerous cases by supporting his decisions with evidence-based practice references, common post-operative and treatment protocols as well as acceptable standards of care for numerous physical therapy related diagnoses. The APTA Guide to Physical Therapist Practice 4.0 is often utilized as a clinical reference to ensure care was delivered based on acceptable standards. The Guide was developed and subsequently updated periodically to ensure consistency of practice parameters within the profession.
